The law can touch family life in various ways, from providing tools to help us prepare for the future to setting down a framework to deal with the legal consequences of the breakdown of a relationship. Our Family Law team aims to make the law work for our clients, helping them to find a solution to what may seem like a difficult problem.
We understand the sensitivity of family matters, and are members of Resolution, which promotes a non-confrontational approach to resolving legal matters. It is for these reasons and more that our Family Law team adopts a positive and constructive approach aimed at minimising emotional and financial burdens. We have an experienced team of specialist Family Lawyers who are supportive and tailor guidance aimed at getting the best possible outcome. Please contact our approachable team to discuss your situation and how we can help.
Our Family Law Work
Divorce and Separation
We understand that no one takes the decision to separate or divorce lightly, yet when the decision is made, we know that our clients want their case dealt with swiftly, and with minimal financial and emotional cost. We will try to avoid a “battle”, especially where there are children involved, and aim to help both parties communicate if they need or want to.
Finance, pension and property arrangements, including claims for unmarried couples
Sorting out finances is often the most complex thing that needs to be dealt with when a relationship breaks down. We have very experienced solicitors throughout our offices who will give you clear advice and represent your interests through initial negotiation to final hearing. We also work closely with skilled actuaries, accountants and financial advisers, meaning we’re well equipped to help you find a solution to what is an important problem that will impact your future.
It is a myth that the law recognises “common law” marriage. The truth is that couples who live together don’t have the same rights as couples who marry or enter into a civil partnership. At Owen White & Catlin, we help clients take the essential steps needed to ensure their interests are protected.
Children – childcare, residence and contact
Disputes or issues relating to children and child arrangements, whether between parents following the breakdown of their relationship or in relation to care proceedings, can be very difficult for all concerned. We have been representing parents, grandparents and other family members for many years. We work in a constructive way from the outset, giving clear advice to ensure that the best approach is adopted and the child’s best interests are protected.
Mediation is a confidential process. The Mediator assists and guides the parties to reach a tailor made solution in relation to their financial and child related issues. It tends to be the quickest and most cost effective way of dealing with disputes arising from the breakdown of a family relationship.
Pre and post-nuptial agreements
Prenuptial and postnuptial agreements are a prudent way of setting out what will happen should a relationship come to an end. We regularly help clients negotiate, draft and review agreements, providing clarity about how matters will be dealt with should the relationship breakdown and ensuring the rights and interests of the parties are protected.
The law protects those who are at risk of threatened or actual violence or harassment. The court can make an order preventing someone from harassing you or threatening or using violence against you. In certain serious cases, the court will also make orders requiring someone who has used violence to leave their property. If you are suffering domestic abuse and would like advice about making an application to the court, please contact as soon as possible.
